CAMERON COUNTY, Pa. (WJAC) — A New York woman is facing multiple charges after a physical altercation lead to a shooting in Cameron County Wednesday afternoon, state police say.
According to a criminal complaint, a state police trooper noticed a woman, later identified as Porice Mincy, 31, running along 4th Street in Emporium before entering a silver vehicle and driving away just after 3 p.m.
State police say, moments later, they received a report of a shooting that had just taken place at Cameron County District Attorney Paul Malizia's office.
The criminal complaint states that a neighbor witnessed Mincy traveling at a high rate of speed down the wrong way of a one-way street on Allegany Avenue before pulling into a residence and entering the home carrying a yellow bag.
According to state police, the neighbor recognized Mincy as her new neighbor who had recently purchased the residence.
The criminal complaint states that state police located Mincy at the residence and took her into custody.
State police say they spoke with Malizia at St. Mary's hospital and that he told them he heard Mincy, who identified herself as "Diamond", come into his office and cause a disturbance.
According to the criminal complaint, Malizia stated that he knew Mincy from a house closing that she completed with her sister.
State police say Malizia told Mincy to leave his office since she was causing a disturbance and did not have an appointment with him.
The criminal complaint states that Mincy proceeded to punch him in the face and that he tried to punch her back, but he missed.
According to state police, Malizia related that he grabbed her by the arm and attempted to remove her from his office.
State police also say that Malizia gathered paperwork he believed Mincy was seeking in an attempt to lure her from his office, but realized she had not followed him down the stairs.
According to the criminal complaint, Malizia returned to his office and found Mincy throwing things around his office that included client paperwork, books, candles and other items.
State police say Malizia then grabbed Mincy by her hair and drug her back into the hallway.
State police also say that, while Malizia was trying to force her to the exit, she bent forward, pressed a handgun into his thigh, and fired a single shot.
According to the criminal complaint, Malizia heard the shot but did not believe he was shot until he saw his leg bleeding.
The criminal complaint also states that Mincy then proceeded to stand up and exit the building with the gun still in her hand.
According to state police, while interviewing Malizia at the hospital, they observed injuries that included scratches on his face, a bloody nose, a bitemark to his left inner thigh and a pass-through gunshot wound to the outer part of his right thigh.
The criminal complaint states that Mincy told them in an interview that the altercation began as an argument about a $1,000 deposit that she believed included the costs associated with a property deed.
State police say she told them the argument turned physical and that Malizia had grabbed her by the hair and began shoving her around his office and said she bit him in the leg in an attempt to escape.
According to the criminal complaint, Mincy said she fled the office after biting Malizia and denied having a handgun.
State police say record checks revealed Mincy to not possess a valid permit to carry a firearm in Pennsylvania.
Online court dockets show Mincy faces one felony charge of aggravated assault with attempt to cause serious bodily injury with extreme indifference, one felony charge of aggravated assault with attempt to cause serious bodily injury to a designated individual, one felony charge of aggravated assault with attempt to cause serious bodily injury with a weapon, one felony charge of firearm not to be carried without a license, one charge of defiant trespassing, one charge of criminal mischief by damage to property, one charge of possession of an instrument of crime with intent, one charge of possession of a weapon, one charge of recklessly endangering another person and two charges of simple assault.
Court dockets also show that Mincy is currently behind held at the Cameron County prison and was denied bail due to having no ties with Cameron County and for being argumentative and a danger to others, and that she has a preliminary hearing scheduled for June 22.
